General Terms and Conditions HSN (Hans Sandor Nagy)

1. General

1.1. These general terms and conditions apply to all services and products of HSN (Hans Sandor Nagy), located at Eigenlostraat 152, 9100 Sint-Niklaas, Belgium, with VAT number BE0866126163.

1.2. By using our services or ordering products from us, you agree to these terms and conditions.

1.3. HSN reserves the right to modify the general terms and conditions at any time. The amended terms shall apply from the moment they are published on the website.

1.4. If any provision of these general terms and conditions is declared void or invalid, the remaining provisions shall remain in full force and effect.

2. Design service

2.1. Jewelry design is a creative service that requires time and expertise. The initial design consultation and discussion are without obligation. However, further designs or detailed renders are subject to a fee.

2.2. The cost for designing a custom-made piece of jewelry is € 150. This cost can be settled with a final order, unless otherwise agreed.

2.3. If no order follows receipt of a design or render, the design fee remains applicable and must be paid within 8 days of receipt of the invoice.

2.4. HSN will always inform clients in advance of possible costs associated with the design process. If a client decides not to continue the process, the costs for services already rendered will remain due.

3. Ordering and Payment

3.1. An order for the manufacture of jewelry is final once the customer has agreed to the design and quotation in writing.

3.2. All payments are due within 8 days of receipt of the invoice, unless otherwise agreed in writing.

3.3. If payment is delayed, HSN reserves the right to stop production of the jewelry until payment is made.

3.4. If a client cancels the project after approval of the design, all costs incurred up to that point will be charged, including the cost of the design and materials used.

3.5. All prices are exclusive of VAT unless otherwise indicated.

4. Warranty and Liability

4.1. All jewelry is manufactured to the highest standard. HSN offers a 5-year warranty against manufacturing and material defects.

4.2. Damage due to misuse, accidents or normal wear and tear is not covered by the warranty.

4.3. The customer is responsible for providing correct information, such as ring sizes or material selections. HSN is not liable for damages or errors resulting from incorrect information provided by the customer.

4.4. HSN's liability is limited to the amount of the invoice for the order in question. No liability is accepted for indirect damages.

5. Changes and Adjustments.

5.1. Clients may make changes to the design after the initial discussion. Additional design fees will be charged if these changes are beyond the original proposal.

5.2. After design approval, no further changes can be made without additional charges.

5.3. Any additional charges will be communicated in writing and must be approved by the customer before being charged.

6. Return and Cancellation Policy.

6.1. Since each piece of jewelry is custom made, it is not possible to return jewelry unless there is a manufacturing or material defect.

6.2. If a customer decides to cancel the order after the production process has started, the costs incurred for the design, materials and work will be charged.

6.3. For custom-made products, the right of withdrawal provided for in Belgian consumer protection legislation does not apply, in accordance with Article VI.53 of the Code of Economic Law.

7. Communication

7.1. All communication regarding the design, quotation and any changes shall be in writing, either by e-mail or written agreement.

7.2. Any complaints should be reported in writing to HSN within a reasonable period of time after discovery of the defects, so that HSN has the opportunity to resolve them.

8. Applicable law

8.1. Belgian law is applicable to all agreements between HSN and the customer.

8.2. Disputes will be submitted exclusively to the competent court in the district of Dendermonde.

9. After-Service and Warranty

9.1. Lifetime After-Service: HSN offers lifetime after-service on all its unique creations for distortion, discoloration and typesetting, under the following conditions:

• Zetwerk Control: The typesetting should be checked within a period of 2 to 4 years after purchase. Appointments for this can only be made through the website.
• Ring Size Guarantee: There is a warranty on the ring size for 1 year from the date of purchase. Exceptions apply to persons on a diet, seriously ill or pregnant.

9.2. Limitations and Exclusions: The warranty does not cover invisible manufacturing defects and damage caused by improper use or heavy labor.

9.3. Unique Creations and Consumer Law: Unique creations of HSN are excluded from the right of withdrawal for consumers as provided in the legislation.

9.4. Warranty Terms and Communication: All communication regarding after-service and warranty shall be conducted exclusively through HSN's official channels. Warranty is void in case of modifications by third parties without written consent.

9.5. Applicable Law and Competent Court: Disputes arising from this warranty and after-sales service shall be subject to the exclusive jurisdiction of the courts of the place of business.
